Terms
The terms for using Goodnight Kiddo
Last updated [date]
Draft for legal review
This is a working draft written in plain language. It has not yet been reviewed by a lawyer and is not final. Items in [square brackets] still need to be filled in.
We’ve tried to write these terms the way we’d explain them to a friend. They cover your account, your plan and credits, what you share with us, and the books we make together.
1.This agreement
These terms are an agreement between you and [legal entity name] (“Goodnight Kiddo”, “we”, “us”). By creating an account or using the website or the iPhone and iPad app, you agree to them and to our Privacy notice. If you don’t agree, please don’t use the service.
2.Your account
- You must be 18 or over and a parent or legal guardian to create an account.
- Accounts are for grown-ups. Children may enjoy the books with you, but they don’t have accounts.
- Keep your password private. You are responsible for what happens in your account.
- One account per family, please. Accounts can’t be sold or transferred.
3.Plans, books and limits
Each plan includes a number of story credits per month. A month is counted from the day your subscription started. Each new book uses credits according to its length, its pictures and its narration, and the app shows how many before you make it. Up to half of a month’s plan credits that you don’t use carry over into the next month only, are used first, and expire at the end of that month. Extra credits you buy don’t expire while you have a plan.
- The first book of a new series also uses credits for the cast’s portraits, series cover and theme melody.
- A family can make at most 2 new books per calendar day in the time zone on their account, however they are paid for.
- Reading or listening to books you already have is always free and unlimited.
- If a book can’t be finished, its credits are handed back automatically.
We may adjust limits to keep the service fair and safe, and we will tell you before any change that affects you.
4.Payment, renewal and cancelling
- On the web, payments are processed by Stripe. In the iPhone and iPad app, purchases are made through Apple and are also subject to Apple’s terms.
- Subscriptions renew automatically at the end of each monthly or yearly period until you cancel. Prices are shown in US dollars before you pay, plus any applicable tax.
- You can cancel any time: on the web from Plan and billing, or for App Store subscriptions in your device’s Settings. Your plan stays active until the end of the period you’ve paid for.
- We will give you at least [30] days’ notice of any price change, and you can cancel before it applies.
- Payments are non-refundable except where the law says otherwise or where we decide to help. App Store refunds are handled by Apple. [Confirm refund and cooling-off wording for UK/EU consumers during legal review.]
5.Extra credits
- Credits pay for new books. Each book uses a few, by its length, pictures and narrator, and you see how many before you make it.
- You don’t need a plan to buy or use them. With a plan, they are used only after that month’s plan credits are gone.
- Packs cost less with a plan than without one. Books paid with credits still count toward the daily limit.
- They don’t expire while your account exists.
- Credits have no cash value, can’t be transferred, and end when your account is deleted.
6.What you give us
You keep ownership of everything you give us: your answers, your child’s details and any photos. You allow us to use them only to provide the service to you, for example to write and illustrate your books, and to share them with the providers listed in our Privacy notice for that purpose.
Please only add details and photos of children you are the parent or guardian of, and only content you have the right to share. Don’t ask for stories that include other people’s private information.
7.The books we make
Books are created with generative AI from your answers. As between you and us, you may keep, read, print and share your books for personal, non-commercial use, for example with family and friends. If you’d like to use them any other way, please ask us first.
Because books are generated, similar ideas, phrases or pictures may sometimes appear for other families, and we can’t promise that a book is unique or that it can be protected by copyright. We work to keep out brands and characters that belong to others; please don’t ask for them.
8.Safety and appropriate use
We design every story to be gentle, and we check what goes in and what comes out. Even so, generated content can occasionally be imperfect, so a grown-up should look over books before sharing them with a child. Stories are for comfort and fun; they are not medical, psychological or educational advice.
Please don’t use Goodnight Kiddo to:
- create anything violent, sexual, hateful, frightening or otherwise unsuitable for children;
- upload images of anyone without the right to do so;
- get around the limits, safety checks or payments, or copy, scrape or resell the service.
We may refuse a request, remove content or suspend an account that breaks these rules.
9.Changes to the service
We are always improving Goodnight Kiddo, so features may change. If we ever stop offering the service, we will give you reasonable notice and refund any unused prepaid period where required.
10.Ending this agreement
You can stop at any time by cancelling your plan and, if you wish, deleting your account from your account page, which deletes your books and data as described in our Privacy notice. We may suspend or close an account that seriously or repeatedly breaks these terms, and will tell you why where we can.
11.Our responsibility to you
We provide Goodnight Kiddo with care, but “as is”: we can’t promise it will always be available or free of mistakes. To the extent the law allows, we are not responsible for losses that weren’t foreseeable, and our total responsibility to you is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits rights you have as a consumer that can’t be limited by law. [Governing law, jurisdiction and dispute wording to be added during legal review.]
12.Changes to these terms and contact
If we change these terms in a way that matters, we will tell you before the change takes effect. Questions are always welcome at zzz@goodnightkiddo.com or [postal address].
